Custom software

Business applications, internal tools, client portals, and the integrations between them. We design against a written scope and deliver source your team can build, read, and change.

Engagements are professional services for businesses. This site does not sell retail goods, courses, consumer subscriptions, or cryptocurrency products.

Process

How an engagement actually runs.

Statement of work

Scope, price, and delivery method in writing. Talking is free. Work starts when you accept the statement of work.

Build

We do the milestone described. A defined milestone is aimed at 3–10 business days unless the statement of work names another date.

Electronic delivery

Private Git repository — GitHub or an equivalent you approve — plus cloud access or files when the scope calls for them. No shipment.

04

Invoice

The invoice follows delivery of that milestone. If a card is used, the charge is made after delivery, not before.

You may cancel in writing within 14 days of accepting the statement of work. Work that has not been delivered is not charged. The full terms are in .

1. Who we are

Garner Digital LLC (“Garner Digital,” “we”) is a Texas limited liability company. Texas Secretary of State file number 6000011724. Principal office: 18023 Golden Ridge Dr, Houston, TX 77084. 2. The agreement

These terms cover use of this website and, together with a statement of work you accept in writing, any services we provide. If the statement of work conflicts with these terms on scope, price, or schedule, the statement of work controls. These terms control on cancellation, delivery method, and liability unless the statement of work gives you a stronger right.

3. Services

We provide business-to-business professional services: custom software, cloud consulting, and digital infrastructure. We do not sell physical goods, courses, consumer subscriptions, or cryptocurrency products through this site. Prices published here are starting points for a typical scope. They are not an offer. The price you pay is the price in the accepted statement of work.

4. Your responsibilities

You provide timely decisions, access, and accurate information. A delay on your side moves the schedule by at least the same amount. You are responsible for the lawfulness of the materials and data you ask us to handle. Do not send card numbers, passwords, or government identifiers through the project form.

5. Intellectual property

When you have paid in full for a milestone, you own the custom work product created for you in that milestone. We keep our pre-existing tools, templates, and know-how, and grant you a license to use them only as they are embedded in the delivered work. Third-party and open-source components remain under their own licenses. We may describe an engagement in general terms — industry and type of system — unless you ask us in writing not to name you.

6. Confidentiality

Each party will use the other party’s non-public information only to perform the engagement and will protect it with reasonable care. This duty does not cover information that is public, already known without a duty of confidence, or independently developed.

7. Payment

We invoice after delivery of the milestone being billed. Payment is due as stated on the invoice. We do not sell subscriptions from this site. A later phase is a new statement of work. If you pay by card, the descriptor on the card statement is GARNER DIGITAL.

8. Cancellation, refunds, and delivery

The Refund & Cancellation policy and the Digital Delivery policy on this site are part of these terms.

9. Use of the site

Do not misuse the form, probe or break the site, or submit unlawful content. We may ignore a submission that looks automated or unsafe.

10. Disclaimers

Services are provided with reasonable professional care. We do not warrant that a third-party cloud, Git host, or network will be uninterrupted or error-free. We do not provide legal, tax, or investment advice.

11. Limitation of liability

To the extent the law allows, our total liability arising out of an engagement is limited to the fees you paid us under that engagement. We are not liable for lost profits, lost data, or indirect or consequential damages. Nothing in these terms limits liability that Texas law does not allow us to limit.

12. Law and disputes

Texas law governs these terms, without regard to conflict-of-law rules. The state courts in Harris County, Texas, and the federal courts sitting there, are the venue, unless a law that protects you requires another forum. Contact us before starting a payment dispute so we can correct an invoice if it is wrong.

13. Changes

We may update these terms by posting a new date on this page. A statement of work you already accepted keeps the terms in effect on the day you accepted it, unless you agree in writing to a later version.

1. Who is responsible

2. Information we collect

  • What you type into the project form: name, corporate email, project scope, and any package you select.
  • Technical data a normal web server records, such as IP address, browser type, and the time of the request, used to keep the site reliable and secure.
  • A preference record when you dismiss the cookie notice.

We do not ask for Social Security numbers, payment card numbers, or government identification on this form. Do not put secrets in the project scope.

3. How we use it

We use this information to answer your inquiry, prepare a statement of work, perform a contract, keep records of that contract, and protect the site. We do not sell personal information. We do not use it for advertising across other sites. We do not use form contents to train public models.

4. Who receives it

The company that hosts this website, the form provider (Web3Forms) if the form is connected, and a professional advisor or authority when the law requires it. We do not share your project note with other clients. Web3Forms is used only to deliver your message to us.

5. How long we keep it

Inquiry records: up to 24 months after our last message, unless a contract or a legal duty requires longer. Contract records: for the life of the engagement and then as long as tax and accounting rules require, typically up to seven years. The cookie preference lasts up to 180 days.

6. Cookies

We store one first-party preference, named gd_pref, so this notice is not shown again. We do not set advertising cookies or analytics cookies on this site.

7. Your choices

Call us or write through the form to ask for access, a correction, or deletion of inquiry information we hold about you. We may keep what the law requires us to keep. If you are a California resident, you may request to know, delete, and not be discriminated against for exercising those rights. We do not sell or “share” personal information as those words are used in the California Consumer Privacy Act.

8. Children

This site is meant for businesses. We do not knowingly collect information from children under 16.

9. Security

The public site is served over HTTPS. No method of sending information is perfectly secure.

Refund & Cancellation

1. What you are buying

Professional services from Garner Digital LLC: custom software, cloud consulting, and digital infrastructure. Nothing on this website is a physical good, a subscription, a course, or an off-the-shelf download.

2. Stages of an engagement

  1. Inquiry. You send a project note or call. There is no charge for the inquiry.
  2. Statement of work. We send a written scope, price, and delivery method. Work starts when you accept it in writing.
  3. Performance. We do the work described for the current milestone.
  4. Electronic delivery. We deliver that milestone by private Git repository (GitHub or an equivalent you approve) and, where the scope says so, cloud access or files. We send written notice when access is ready.
  5. Invoice. We invoice after that delivery. If you pay by card, the charge is made after delivery of the milestone being billed, not before it.
  6. Close. When the last milestone is delivered and paid, the engagement ends unless you accept a new statement of work.

We do not enroll you in a subscription. A later phase is a new written scope.

3. Fourteen-day cancellation window

You may cancel the engagement by written notice within 14 days after you accept the statement of work.

If you cancel inside that window and we have not yet delivered the milestone in question, you owe nothing for the undelivered work. If any amount was collected for work that was not delivered, we refund it.

If a milestone was already delivered before you cancel, the fee for that delivered milestone remains due. Milestones not yet delivered are cancelled with no charge.

4. How to cancel

Send written notice to support@garnerdigital.dev or contact@garnerdigital.dev, through the contact form on this site, or by mail to 18023 Golden Ridge Dr, Houston, TX 77084. You may also call +1 (832) 689-4720 to start the notice. We will confirm the cancellation in writing.

5. After the 14-day window

You may still stop future milestones that have not been delivered. You pay only for milestones already delivered. We do not charge a separate cancellation penalty.

6. Refunds

A refund applies to amounts taken for work that was not delivered. We return those amounts to the original payment method within 10 business days after we confirm the cancellation in writing.

Delivered custom work is not refundable and cannot be “returned.” If a delivery does not match the statement of work, tell us in writing within 10 business days of the delivery notice. We will correct it at no extra fee or, if we cannot correct it, refund the fee for that milestone.

7. If a charge looks wrong

Digital Delivery

1. Electronic only

Every deliverable from Garner Digital LLC is electronic. We do not ship discs, paper binders, equipment, or other physical media as part of a standard engagement. There is no parcel, warehouse, or shipping tracking number.

2. How delivery is made

  • Source code and project files go to a private Git repository, typically GitHub, that you own or that we transfer to you.
  • Environment definitions, infrastructure files, and written notes go in that repository or in a named secure cloud folder.
  • At handover, administrative ownership and credentials for the delivered environment move to you.

3. When delivery happens

A defined milestone is delivered within 3 to 10 business days after kickoff, or after you accept the previous milestone, unless the statement of work states a different date. A Discovery Sprint is usually complete in 5 to 10 business days.

4. What “delivered” means

A milestone is delivered when we give you access to the repository, files, or environment described in the statement of work and send you written notice. The delivery date is the date of that notice.

5. Your review

You have 10 business days after the delivery notice to tell us, in writing, that the milestone does not match the statement of work. If we do not hear from you in that time, we treat the milestone as accepted for invoicing. You may still report a later defect that we can reasonably correct under the statement of work.

6. What we need from you

Delivery depends on access you agreed to provide: a repository, a cloud account, or a decision that is named in the statement of work. If that access is late, the delivery window moves by at least the length of the delay.
